Terms of service

These terms are the agreement between you and ATLASIQ PTY LTD, a company registered in South Africa (“AtlasFetch”, “we”), covering your use of the AtlasFetch API and website. By creating an account or calling the API you accept them.
1. The service
AtlasFetch resolves a coordinate to the administrative boundaries that contain it, and to any custom boundary sets you have uploaded. We may change, add or remove features. If we make a change that materially reduces what a paid plan provides, we will tell account holders by email first.
2. Accounts and API keys
You need an account to use anything beyond the public demo. You are responsible for what happens under your account and for keeping your API keys secret. Treat a key like a password: anyone holding it can spend your quota. Keys are stored hashed and shown only once, so if you lose one, create a replacement and revoke the old one.
Tell us promptly at atlasfetch@atlas-iq.co if you believe a key has been exposed.
3. Plans, quotas and fair use
Each plan includes a monthly allowance of lookups and a per-key rate limit, shown on the pricing page. One API call is one lookup, however many layers or sets it touches. When the allowance is exhausted, lookups are refused until the period resets or you upgrade. Requests above the rate limit are refused.
The public demo key is shared by everyone. Its quota is pooled, it carries no uptime expectation, and we may change or withdraw it at any time.
4. Payment
Paid plans are sold through Paddle, which acts as our merchant of record. Your purchase contract for the transaction is with Paddle, and Paddle's buyer terms apply to it alongside these terms. Paddle handles payment, invoicing and any sales tax or VAT.
Subscriptions renew monthly until cancelled. Cancel any time; access continues to the end of the paid period. Prices are shown exclusive or inclusive of tax as indicated at checkout, and we may change prices with notice to existing subscribers before their next renewal.
5. Refunds and cancellation
Cancelling. You can cancel a subscription at any time from your dashboard or by emailing us. Cancellation stops the next renewal; your plan stays active until the end of the period you have already paid for, and you keep full access until then.
Refunds on cancellation. We do not refund the unused part of a billing period as a matter of course — you keep the access you paid for instead.
When we will refund. Email atlasfetch@atlas-iq.co within 14 days of a payment and we will refund it in full if:
- the service did not work as described and we could not put it right;
- you were charged after cancelling, or charged twice;
- you upgraded or subscribed by mistake and have not meaningfully used the plan.
We would rather refund someone who is unhappy than argue about it, so if your situation is not on that list, ask anyway and we will look at it. Refunds are issued by Paddle to your original payment method and typically take 5–10 working days to appear.
Your statutory rights. If you are a consumer in the UK or EU you have a 14-day right to cancel a distance contract. Because AtlasFetch gives you immediate access to a digital service, that right ends once you start using it with your express consent — but nothing here limits any right you have under consumer law, and this policy is in addition to those rights, not instead of them.
We may decline a refund where an account has consumed a substantial share of its plan allowance, or where we reasonably believe the request is an attempt to obtain the service without paying for it.
6. Acceptable use
You may not:
- resell or redistribute raw access to the API as a competing lookup service;
- attempt to extract or reconstruct our boundary database in bulk;
- share an API key outside your organisation, or use one key to serve multiple unrelated customers as a way around plan limits;
- probe, scan, or attempt to bypass quotas, rate limits or authentication;
- use the service unlawfully, or to process data you have no right to process.
Building your own product on top of AtlasFetch lookups is exactly what it is for — this clause is about wholesale copying of the service or its data, not normal use.
7. Your data
Boundary sets and geometries you upload remain yours. You grant us only the licence needed to store and process them so we can answer your lookups. We do not use your uploaded data to improve our own datasets or for any other purpose.
You are responsible for having the right to upload what you upload. Where that content contains personal information, you are the controller and we act as your processor, as set out in our privacy policy.
8. Boundary data and attribution
Our administrative boundaries are derived from OpenStreetMap and are made available under the Open Database License (ODbL). If you publish, redistribute or display results derived from that data, the ODbL's attribution and share-alike terms apply to you as well. See our attribution page for the credit line to use.
9. Accuracy — please read
Boundary data is community-maintained and is not an authoritative or legal recordof any border, jurisdiction or administrative area. Coverage, naming and precision vary by country, and some places are absent or out of date. Administrative levels differ between countries, so the “municipality” returned for one country may not be the same kind of unit as another's.
Do not rely on AtlasFetch as the sole basis for anything where a wrong answer causes real harm — emergency dispatch, navigation-critical routing, statutory tax determination, electoral boundaries, insurance underwriting, or legal determinations of jurisdiction. Verify against an authoritative source for those uses.
10. Availability
We aim to keep the service running and available, but we do not currently offer a contractual uptime guarantee or service credits. We may take the service down for maintenance, and will try to do so with notice where the work is planned.
11. Warranties and liability
The service is provided “as is”. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill. Our total liability arising out of or in connection with these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
12. Suspension and termination
You may stop using the service and delete your account at any time from the dashboard. We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used unlawfully, or for which payment has failed. Where circumstances allow, we will warn you first and give you a chance to put it right.
13. Changes to these terms
We may update these terms. The date at the top shows when they last changed, and we will notify account holders by email of material changes before they take effect. Continuing to use the service after that constitutes acceptance.
14. Governing law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country.
